We are going to Chitwan and I will be doing an elephant trek. I understand that there are no wild elephants in Nepal and just wanted to check that the elephants used are well cared for and not subject to any cruelty.

I just read a news story today saying that Discovery Channel is counting the wild elephants of Nepal next year. In its previous count in 2001, around 60-75 elephants were found in one national park alone. According to experts on this field, there are around 150 wild elephants in Nepal and some are inhabit in the Chitwan National Park as well.
I think elephants are treated without cruelty.
